Összefoglaló
A tanulmány kiindulópontja, hogy a szokásjogi elemek a 19. század végi kodifikáció, sőt a 20. század végi alkotmányos rendszerváltozás után sem tűntek el nyomtalanul és maradéktalanul a büntetőjog felelősségi rendszeréből. A tanulmányban sor kerül e szokásjogi elemek rövid rendszerezésére, ezt követően pedig két jogintézmény részletes vizsgálata következik. Az anyagi büntetőjog alapelvei köréből a kétszeres értékelés tilalma az, amelynek vannak kizárólag szokásjogi alapú jelentéstartalmai. Éppen ezt az alapelvi zónát teszi erőteljesen próbára a 2025. évi kábítószer-novella, amelyet ezért a kétszeres értékelés tilalma nézőpontjából vesz górcső alá a tanulmány, rávilágítva a régi szokásjogi alapelv és az új írott jog kollíziójára. Végül pedig sor kerül a fiatalkorúak belátási képességének elemzésére, ahol – a szerző álláspontja szerint – új, szokásjogi képződésű felelősségi elem mutatható ki.

Customary Law Elements in the Contemporary System of Criminal Liability
Abstract
The starting point of this study is that elements originating in customary law have not disappeared entirely or without trace from the system of criminal liability, even after the codification processes of the late nineteenth century and the constitutional transition to democracy at the end of the twentieth century. The study begins with a brief classification of these customary-law elements and then proceeds to a detailed examination of two specific legal institutions. Among the general principles of substantive criminal law, ne bis in idem is the one whose content still contains elements resting exclusively on customary-law foundations. It is precisely this principle-based domain that is placed under considerable strain by the 2025 amendments to the drug legislation. Accordingly, the study scrutinizes the amendments from the perspective of the principle of ne bis in idem, thereby highlighting the conflict between an old customary-law principle and newly enacted statutory law. Finally, the study turns to the analysis of the capacity for discernment of juveniles, where, in the author’s view, a new element of criminal liability shaped through customary-law development can be identified.
